(A) The owner or occupant of any property located within the village within the R1, R2, or R3 Districts, and property used for residential purposes within the R4 District, is exempt from the obligation to clear accumulations of ice and snow from the public sidewalks adjoining their property if the Village Manager or his or her designee determines that compliance with § 92.15(A) would result in a physical or economic hardship.
(B) A person may not claim the exemption in an enforcement proceeding under this section unless the person has applied for and obtained the exemption from the Village Manager or his or her designee prior to the date of any violation of this subchapter.
