§ 51.08 STORING OR SCATTERING SOLID OR HEAVY WASTE.
   (A)   No person shall place any solid or heavy waste within any street, alley or other public place or upon any private property, whether owned by such person or not, within the town, except in proper containers for collection or disposal or under express approval granted by the Mayor or his or her designee, nor shall any person throw or deposit any solid or heavy waste in any stream or any other body of water.
   (B)   Any unauthorized accumulation of solid or heavy waste on any premises is declared to be a nuisance and is prohibited.
   (C)   No person shall cast, place, sweep or deposit anywhere within the town any solid or heavy waste in any manner that may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public place, or onto any occupied premises within the town. The owner and occupant of the premises shall be charged with the responsibility to use due diligence and care to protect the contents of all bags or receptacles for solid or heavy waste used in connection with such premises from being opened, blown or scattered by the wind upon, over and across public or private property, and a failure to so exercise such diligence shall be punishable as provided in this chapter.
   (D)   No person shall be authorized or allowed to place, cast, scatter, deposit or otherwise locate any solid or heavy waste of any nature on any property owned by the town, whether within the town or without, except as may be permitted in this chapter under the compliance with the ordinances of the town or rules or regulations of the town or the Mayor.
   (E)   No person shall place or dispose of any solid or heavy waste in any container upon any property without the effective consent of the owner of such property.
   (F)   The burning of household waste of any kind in any place within the town limits is prohibited. The burning of paper, leaves and branches will be permitted, but must be strictly supervised until the fire is completely extinguished. Any person leaving the site of a fire still burning is in violation. It shall be unlawful for any person, within the corporate limits of the town to knowingly, intentionally, recklessly or with criminal negligence to burn or cause to be burned any paper, leaves, branches or use of pyrotechnics when the Mayor and Emergency Management Coordinator and/or Town Council have declared a burning ban for a specified period of time due to atmospheric conditions or local circumstances making such fires or use of pyrotechnics hazardous to the health, safety and general welfare of the public. The public will be notified of a burning ban by the posting of a notice in the display case at the mail room.
   (G)   No person shall meddle or tamper with any solid or heavy waste container or with any solid or heavy waste or in any manner pilfer from such solid or heavy waste container without the effective consent of the owner thereof.
   (H)   The storing or keeping of any solid or heavy waste so as to produce an unsightly or ugly appearance, or which may harbor reptiles or rodents, create a fire hazard or result in any unsanitary conditions, is declared to be a public nuisance and is unlawful. Every owner of any premises shall keep said premises free and clear of solid or heavy waste unless in an appropriate container provided for the same.
   (I)   No person shall cast, place, deposit or dispose of any type of solid or heavy waste on the grounds surrounding the solid waste container. If solid waste container has been temporarily removed for emptying, functioning improperly or filled to its capacity, said waste shall not be deposited, left or abandoned at that time. Failure to comply shall be a violation of this chapter.
