§ 72.10 DEFACEMENT OF DEVICES.
   (A)   Prohibition. No person shall without lawful authority attempt to or in fact alter, destroy, deface, molest, interfere, tamper, injure, knock down, remove or have in his or her possession any traffic control device or any railroad sign or signal or an inscription, shield or insignia thereon, or any part thereof.
   (B)   Exceptions. This chapter shall not apply to any of the following persons when acting within the scope and duty of their employment:
      (1)   Any officer, agent, independent contractor, employee, servant or trustee of any governmental agency; or
      (2)   Any officer, agent, independent contractor, employee, servant or trustee of any contractor, public utility or railroad company.
