11-2-2-4: FEES:
   A.   In order to cover the costs of examining the layout, advertising and holding public hearings, recording fees and other expenses incidental to the approval of a subdivision, the subdivider shall pay a fee at the time of application for conditional approval of a preliminary plat. There will be no refund of any portion of the fee if the subdivider fails to apply for final approval of the subdivision. If, because of the failure of the subdivider to submit a final plat within twelve (12) months after receiving conditional approval of a preliminary plat, it is necessary to resubmit a preliminary plat for conditional approval, the subdivider shall be required to pay the fee currently in effect at the time of resubmission. The fees for approval of a subdivision shall be charged and collected at the following rates:
      1.   Where a public hearing is required, as in the case of variations: Three hundred fifty dollars ($350.00).
      2.   Where no public hearing is required: One hundred dollars ($100.00).
   B.   All fees established by this section are in addition to any sums paid to cover costs of preparation of improvement plans and field inspection of construction as required under the provisions of this chapter, tax search, copies and recording. (1985 Code § 10-2-2-4)
