10-1-2: SCOPE AND EFFECT:
   A.   The provisions of this Title apply to all persons including, and not limited to, any tenant, lessor or lessee, owner, rental agent, occupant, firm or corporation, or agents, employees, or contractors of such.
   B.   This Title does not repeal any existing laws in regards to buildings, sanitation, or otherwise, where not inconsistent herewith.
   C.   This Title is adopted to the end:
      1.   That the public health, safety, comfort, morals, convenience, and general welfare may be otherwise promoted;
      2.   That adequate light, pure air, and safety from fire and other dangers may be secured;
      3.   That the taxable value of land and buildings throughout the Village may be conserved;
      4.   That congestion in the public streets may be lessened or avoided;
      5.   That the hazards to persons and damage to property resulting from the accumulation of runoff of storm or flood waters may be lessened or avoided;
      6.   That will ensure and facilitate the preservation of sites, areas, and structures of historical, architectural, and aesthetic importance; and
      7.   That aesthetic value throughout the Village may be preserved and enhanced.
   D.   To achieve these ends, this Title sets forth regulations and standards:
      1.   To regulate and limit the height and bulk of buildings hereafter erected;
      2.   To establish, regulate and limit the building or setback lines on or along any street, traffic way, drive, parkway, storm or flood water runoff channel or basin, or other property line;
      3.   To regulate and limit the intensity of the use of lot areas and to regulate and determine the area of open spaces within and surrounding buildings;
      4.   To classify, regulate and restrict the location of trades and industries and the location of buildings designed for specified industrial, business, residential, and other uses;
      5.   To divide the entire Village into districts of such number, shape, area, and of such different classes (according to use of land and buildings, height and bulk of buildings, intensity of the use of lot area, area of open spaces, or other classification) as may be deemed best suited to carry out the purposes of this Title;
      6.   To fix standards to which buildings or structures therein shall conform;
      7.   To prohibit uses, buildings, or structures incompatible with the character of such districts;
      8.   To prevent additions to and alterations or remodeling of existing buildings or structures in such a way as to avoid the restrictions and limitations lawfully imposed under this Title;
      9.   To classify, regulate, and restrict the use of property on the basis of family relationship, which family relationship may be defined as one or more persons each related to the other by blood, marriage, partnership, or adoption and maintaining a common household or partnership;
      10.   To provide for the gradual elimination of uses, buildings, and structures, which are incompatible with the character of the districts in which they are made or located;
      11.   To define and limit the powers and duties of the Administrative Officers and bodies as hereinafter provided; and,
      12.   To prescribe penalties for the violation of the provisions of this Title or any amendment thereto. (1985 Code § 9-1-2; amd. Ord. 22-04, 4-11-2022)
