A. Board And Fund Established: There is hereby created and established the board of trustees of the police pension fund of the village and the village police pension fund. (Ord. 87-7, 5-11-1987)
B. Definitions: The terms used in this section, for the purposes of this section, shall have the following meanings, except when the context requires otherwise:
BOARD: The board of trustees of the police pension fund of the village of Hodgkins, Illinois.
CHILD OR CHILDREN: A policeman's natural children and his legally adopted children.
CREDITABLE SERVICE: That service shall be computed as set forth in the Illinois pension code.
DEATH BENEFITS: 1. That upon the death of a police officer entitled to a pension under the provisions of this section, his or her surviving spouse, or his or her surviving minor children dependent because of physical or mental disability regardless of age, or dependent because of age, or his or her surviving dependent parent or parents if such there be, shall be entitled to the pension to which the police officer was then entitled.
2. Upon the death of a policeman who has at least twenty (20) years of creditable service, or upon the death of a policeman who retired from service with at least twenty (20) years of creditable service, whether his death occurs before or after he has attained age fifty (50), or before or after his application for retirement on pension, the pension to which the decedent would have been entitled, had he lived and applied for pension as of the date of his death, shall be paid to his dependents as provided upon death of a pensioner in subsection 1 of this definition.
DISABILITY PENSIONS: Disability pensions in the amount set forth in the Illinois pension code shall be payable to a disabled policeman upon the conditions therein set forth.
GENDER: The term policeman includes policewoman and words importing the masculine gender import the feminine gender, unless such construction would be inconsistent with the manifest intention of the context.
PENSION AMOUNT: The amount of the pension to be received by any policeman shall be computed in accordance with the provisions of the Illinois pension code.
PERSONS EXCLUDED: 1. Part time policemen, special policemen, night watchmen, temporary employees, traffic guards or so called auxiliary policemen specially appointed to aid or direct traffic at or near schools or public functions, or to aid in civil defense, municipal parking lot attendants, clerks or other civilian employees of a police department who perform clerical duties exclusively.
2. Any policeman who fails to pay the salary payments or deductions herein defined, computed from the date the village became subject to article 3 of the Illinois pension code by attaining a population of five thousand (5,000), and continuing during his entire service as a policeman. A policeman who is reappointed shall, before being declared eligible to participate in the pension fund, repay to the fund as required by section 3-124 of the Illinois pension code any refund received pursuant to said section.
3. Any appointed noncivil service policeman.
POLICEMAN, POLICEMEN, MEMBER OF THE FORCE: 1. Any person who:
a. Is heretofore or hereafter appointed to the police force of the police department and sworn and commissioned to perform police duties; and
b. Is found, upon examination of a duly licensed physician or physicians selected by the board, to be physically and mentally fit to perform the duties of a policeman; and
c. Within three (3) months after receiving his first appointment, and of reappointment, within three (3) months thereafter, makes written application to come under the provisions of article 3 of the Illinois pension code.
2. Policemen serving initial probationary periods, if otherwise eligible, shall be policemen within the meaning of this subsection. (Ord. 87-7, 5-11-1987; amd. 2016 Code)
C. Pension Fund Provisions:
1. Effect On Retirement Of Police Officers: Nothing contained in this section shall be construed as requiring the retirement at age fifty (50) of any policeman who is capable of performing his duties. (Ord. 87-7, 5-11-1987)
2. Death In The Line Of Duty: There shall be paid to the spouse, minor children, or dependent parents of a police officer who is killed in the line of duty, those benefits in such case made and provided under the Illinois pension code. (Ord. 87-7, 5-11-1987; amd. 2016 Code)
3. Financing Of Fund: The cost of providing the pension benefits required to be paid by the village under the provisions of the Illinois pension code and this section shall be financed by the levy of a tax pursuant to the provisions of section 3-125 of the Illinois pension code.
D. Board Of Trustees Of Fund:
1. Membership; Appointive And Elective Members:
a. Membership: The board shall be composed of five (5) members. Two (2) members of the board shall be appointed by the village president. The third and fourth members of the board shall be elected from the regular police force by the active members thereof. The fifth member shall be elected by and from among the beneficiaries of the fund.
b. Terms Of Appointive Members: One of the board members appointed by the president shall serve for one year beginning on the second Tuesday in May. The other appointed member shall serve for two (2) years beginning on the same date. The successors of the appointed members of the board shall serve for two (2) years each or until their successors are appointed and qualified. (Ord. 87-7, 5-11-1987)
c. Biennial Election: The election provided for in this subsection D1 for elected board members shall be held biennially on the third Monday in April at such place or places in the village and under the Australian ballot system and such other regulations as shall be prescribed by the appointed members of the board. d. Authority To Vote; Terms Of Elective Members: All members of the regular Hodgkins police force shall be entitled to vote only for the police force members of the board. All beneficiaries of legal age shall be entitled to vote only for the member chosen among the beneficiaries. No person shall be entitled to cast more than one ballot at such election. The members shall be elected for a term of two (2) years beginning on the second Tuesday of the first May after such election. (Ord. 87-7, 5-11-1987)
e. Vacancies: Upon the death, resignation or inability to act of any member of the board elected under this subsection D1, his successor shall be elected for the unexpired term at a special election to be called by the board and conducted in the same manner as the regular biennial election. 2. Organization:
a. Meetings: The board shall hold regular quarterly meetings on the second Tuesday of July, October, January and April annually and special meetings as called by the president.
b. Officers:
(1) At the regular July meeting, the board shall select from its members a president, vice president, secretary and assistant secretary to serve for the period of one year and until their respective successors are elected and qualified.
(2) The vice president of the board shall perform the duties of the president during any vacancy in that office, or during such time as the president is absent from the village, or if for any other reason is disqualified or by reason of illness or other causes is unable to perform his duties.
(3) The assistant secretary shall act for the secretary whenever necessary to discharge the functions of such office. (Ord. 87-7, 5-11-1987)
3. Powers And Duties: The board shall have those powers and duties set forth in the Illinois pension code generally, and particularly those powers set forth in sections 3-132 through 3-140.1 thereof. (Ord. 87-7, 5-11-1987; amd. 2016 Code)
4. Compensation: Members of the board shall receive no money or monies from a pension fund as salary for services performed as members of such board.
E. Compliance With State Law: It is the intention of the corporate authorities that the provisions of this section shall, in all respects, comply with and be consistent with the provisions of the Illinois pension code, and this section shall be construed so as to give it that effect.
