5-2-3: WEEDS, GARBAGE AND DEBRIS:
   A.   It shall be unlawful for any owner, lessee or occupant, or any agent, servant, representative or employee of such owner, lessee or occupant, having control of any lot or part of a lot to: (1985 Code § 4-2-3)
      1.   Weeds:
         a.   Within two hundred feet (200') of any building occupied as a private residence or place of business, allow or maintain on any such lot or part thereof any growth of weeds to a height in excess of ten inches (10"). (Ord. 93-13, 7-12-1993)
         b.   Allow the growth of noxious weeds, as defined in state law, to any height.
      2.   Garbage And Debris: Allow garbage and debris to remain thereon or allow the accumulation of garbage or debris in any public alley, sidewalk, parkway or street contiguous thereto. (1985 Code § 4-2-3)
      3.   Abandoned, Wrecked Vehicles: Allow an abandoned, wrecked or partially wrecked motor vehicle to remain thereon, except on lots duly licensed as motor vehicle repair shops.
      4.   Diseased Dutch Elm Trees: Allow a diseased Dutch elm tree to remain on the premises.
   B.   It shall be the duty of every owner to cut such weeds and to remove the garbage, debris and abandoned, wrecked or partially wrecked vehicles at his own expense. In the event said owner refuses or neglects to cut said weeds or remove the garbage, debris and vehicles as herein provided, the village may provide for the cutting or removal of the same and collect the reasonable costs thereof from the owner after service of a notice on the person who refuses or neglects to do so. The notice of the time to remove or correct shall depend on the hazard to the health or danger to the public but in no case shall exceed five (5) days. The village shall file a lien upon the real estate affected which shall include the cost, plus interest at five percent (5%) per annum from the date said cost was incurred, together with the cost of recording. The lien may be enforced by proceeding to foreclose as in the case of mortgages or mechanics' liens. Suit to foreclose this lien shall be commenced within two (2) years after date of the filing of the lien. (1985 Code § 4-2-3; amd. 2016 Code)
