5-2-1-1: RECREATIONAL BURNING AND COOKING OUTDOORS:
   A.   Definitions: When used in this section, the following terms shall have the following meanings:
   DENSE SMOKE: Smoke with a degree of density of number 3 on the Ringelmann smoke chart, or greater, for more than six (6) minutes in any one hour, whether such period of time is consecutive or not.
   FIRE RING: A construction or device used to contain fires and prevent them from spreading into a wildfire.
   GARBAGE: Refuse resulting from the handling, processing, preparation, cooking, and consumption of food or food products.
   OPEN BURNING: The combustion of any matter in the open or in an open dump.
   OUTDOOR FIREPLACE: A device designed to be used for recreational burning which is portable or permanently affixed to the ground and is located outside of a structure or building.
   RECREATIONAL BURNING: Fires for the express purpose of cooking food for human consumption contained inside grills, charcoal burners, or the like; fires within a dry stacked stone, masonry, or metal fire pit/ring, or commercially manufactured portable fireplaces.
   REFUSE: Any discarded matter including, but not limited to, garbage, sweepings, landscape waste, paper, cardboard, tin cans, ashes, bottles and/or similar matter.
   SEASONED LOGS: Logs that are aged or dried.
   YARD WASTE: Accumulations of grass or shrubbery cuttings, leaves, tree limbs, and other materials generated as the result of lawn care.
   B.   Conditions Of Burning: Recreational burning shall be permitted only under the following conditions:
      1.   An outdoor fireplace or fire ring shall be placed at a safe and reasonable distance from any building, structure, or vehicle, or from any container or other source of flammable liquids or vapors and shall not be placed on any combustible surface.
      2.   An outdoor fireplace or fire ring shall only be fueled by seasoned logs or its equal.
      3.   A water source or other provisions for extinguishing the fire shall be immediately accessible and attended constantly by a person eighteen (18) years of age or older at all times when the outdoor fireplace or fire ring is in use.
      4.   The burning of any refuse, yard waste or any other combustible material in an outdoor fireplace or fire ring is prohibited.
      5.   An outdoor or portable fireplace shall not be used in such a manner as to emit dense smoke, or objectionable smoke/odors, or when atmospheric conditions or other circumstances make such fires hazardous.
   C.   Exemptions: Charcoal grills, burners or like devices used solely for the cooking of food are allowed and are not subject to the provisions contained in subsection B of this section. (Ord. 13-11, 9-9-2013)
