§ 93.059 BURNING REFUSE.
   (A)   It is unlawful to burn any trash or refuse or any type of material within the city, except as otherwise provided for in divisions (B) and (C) below.
   (B)   It is unlawful for any person to burn trash, wastepaper, rubbish, or refuse except under a permit issued by or in receptacles and conditions approved by the State Health Department or U.S. Environmental Protection Agency.
   (C)   Upon preapproval from the Fire Chief, any outdoor recreational burning must be conducted on a ten foot by ten foot noncombustible surface in a UL approved burn container with a proper cover or a flue, including chimneys. Violations of this section are subject to penalties under § 93.999.
