(A) No person shall drive, operate, or be in actual physical control of any motor vehicle upon any highway who is under the influence of any substance included in the Uniform Controlled Dangerous Substance Act, being 63 O.S. §§ 2-101 et seq. The fact that any person charged with a violation of this provision is or has been lawfully entitled to use such controlled substance shall not constitute a defense.
(B) Any person who violates this section shall be guilty of an offense and, upon conviction thereof, shall be punished as provided in § 71.999.
