A. Receipt of Decision; Consideration; Decision: As soon as practicable, but in no event later than sixty (60) days following a Commission vote approving a certificate of appropriateness involving the demolition, relocation or removal of an existing residence or construction of a new residence in the Robbins Park Historic District with conditions the applicant does not accept, or denying the proposed certificate of appropriateness, the Village Board shall review the decision of the Commission and either deny the certificate of appropriateness or approve the certificate of appropriateness, with or without conditions. The applicant, property owner and design professional must be in attendance at the meeting where the Village Board considers the application to ensure both receive and understand any comments provided by the Board. The only notice required for the Village Board consideration shall be by electronic mail to the applicant at the address provided in the application and, if the applicant is not the owner, to the owner of the subject property. Unless such time is extended by agreement of the applicant, or the applicant, property owner and/or design professional failed to appear at a meeting or meetings as required by this section, the failure by the Board to act within sixty (60) days, shall be deemed approval by the Board of the certificate of appropriateness. The final decision of the Board is advisory.
B. Issuance of Certificate: Following the decision of the Village Board, the Village shall issue the certificate of appropriateness permitting the Building Commissioner to proceed with other required reviews and approvals. Decisions of the Board on applications in the Robbins Park Historic District are merely advisory and shall not prohibit an applicant from proceeding with the proposed course of action within the historic district upon receiving all other required approvals and permits therefor.
C. Validity: A certificate of appropriateness issued pursuant to this section shall be invalid if the plans approved by the Village Board are substantially changed, if any conditions of the certificate are not satisfied, or if any building permit issued for the approved work becomes invalid. Actions authorized to be taken following a decision on a certificate of appropriateness must be taken within a period of three years following the decision. (Ord. O2024-07, 4-2-2024)
