11-1-16: APPROVAL OF FINAL SUBDIVISION PLATS:
   A.   Approval by Plan Commission: After approval of a final subdivision plat by the Plan Commission, the certificate thereon denoting said approval and date thereof shall be signed by the chairman of the Plan Commission and attested by the secretary. The secretary shall then transmit the approved final plat to the Village Board together with a document of transmittal calling the Board's attention to all variations (if any) approved by the Plan Commission and setting forth its reasons for approving said variations and conveying to the Board such other information concerning the subdivision as the Plan Commission may deem necessary or advisable. With the approved final plat, the secretary of the Plan Commission shall also transmit to the Village Board the subdivider's agreement with respect to improvements, the approval of the enforcing officer of all said improvements, together with plans, specifications, estimates and escrow agreements, and all other documents, certificates and papers pertaining to the final plat and the subdivision platted thereon; except that the Village Board may waive the requirement as to receiving documents at that time pertaining to proposed improvements as specified immediately above and approve the final plat without said documents; provided, that all such required documents shall be delivered to the enforcing officer before the final plat is recorded.    B.   Approval by Board of Trustees: When the Board of Trustees is satisfied with the final plat and with all proposed improvements, conditions, and documents as submitted pertaining to the subdivision platted therein, the Board of Trustees shall approve the final plat and authorize and direct the Village President and the Village Clerk to sign the "approved" certificate on the final plat, including the date of such signature, and to affix the Village Seal thereto. The Board of Trustees' approval of the final plat may be subject to appropriate conditions that must be fulfilled prior to the recording of the final plat, such as, without limitation, submission by the subdivider of cash as required by Section 11-1-11 of this Code to ensure the proper installation of all public improvements attendant to the subdivision. Before the Village Clerk shall sign or affix the Village Seal to the final plat, the subdivider shall fulfill all conditions imposed by the Board of Trustees on the approval of the final plat and, in addition, shall pay to the Village Clerk the fee of twenty dollars ($20.00) for each of the first five (5) lots platted on the final plat and five dollars ($5.00) for each lot in excess of five (5) lots, but in no event shall the total fee be less than fifty dollars ($50.00). Such fee shall be in addition to the recording fees required pursuant to subsection C of this Section.
   C.   Recording of Plat; Fees; Time Limit: The Village Clerk shall retain each approved final plat until the subdivider has 1) fulfilled all conditions imposed by the Board of Trustees on the approval of the final plat, and 2) submitted to the Village cash to ensure the proper installation of all public improvements attendant to the subdivision as required by Section 11-1-11 of this Title, and 3) deposited all escrow funds, inspection fees, and other materials and documents that may be required with the final plat, and 4) paid the fee provided in subsection B of this Section, and 5) paid to the Village Clerk a sum estimated by the Village Clerk to be the cost of recording the final plat. The Village Clerk shall cause the final plat to be recorded, but only after all such requirements have been fulfilled. The original final plat shall be retained permanently in the Village's files. No final plat approval shall be valid for a period longer than one year unless all conditions attached to such final plat approval have been fulfilled and the final plat has been recorded. (3-15-94)
   D.   Conflict of Jurisdiction: The Plan Commission claims full jurisdiction over platting of subdivisions and improvements thereon on all subdivisions outside the Village limits, except as modified herein, within the boundaries described in section 10 of the Plan. However, in the matter of water supply and sewage disposal for individual lots or subdivisions as a whole where it is not feasible to supply such lots or subdivisions with water or sewage service from existing public water or sewage systems, the said Plan Commission waives jurisdiction over such water and sewer installations in favor of control of same by the county in which located. The enforcing officer shall notify the proper county authorities in such circumstances. (2-3-76)
