11-1-4: EXCEPTIONS FOR EXISTING SUBDIVISIONS:
The applicable requirements of this Chapter within the corporate limits of the Village may be waived when the following conditions are met:
   A.   Where the proposed subdivision will not result in reducing the side yard or rear yard of an existing building or accessory building below existing minimum zoning requirements.
   B.   Where the proposed subdivision will not result in reducing frontage, depth or area of any previous existing lot or parcel of land below the existing minimum zoning requirements. (Ord., 2-3-1976)
   C.   In any residential district, when the proposed subdivision does not result in the creation of any additional buildable lot or parcel of land. For purposes of this subsection, a "buildable lot" or "parcel of land" is defined as one which has the minimum lot area and dimensions such that it may be developed pursuant to the Hinsdale zoning code.    D.   Where the proposed subdivision is not in a special management area as defined in Title 12 of this Code.
   E.   Where the proposed subdivision encompasses land less than three (3) acres of single-family residential or one acre of other zoned land. (Ord., 3-17-1992)
The waiving of the applicable requirements of this Chapter shall be allowed by the enforcing officer only when all the conditions specified in subsections A through E of this Section are met, and only after a plat of the proposed subdivision has been filed with the enforcing officer giving all necessary information needed to determine whether the conditions specified in said subsections A through E above are complied with.
