6-16-3: ELIGIBILITY FOR IMMOBILIZATION; LIABILITY:
   A.   Eligibility: Subject to the notice and hearing requirements of Section 6-16-4 of this Chapter, a vehicle shall be eligible for inclusion on the vehicle immobilization list at any time after ten (10) or more citations, which have not been paid and which have been issued against the vehicle's registration charging that such vehicle was parked or stopped in violation of any ordinance of the Village or any law of the State. Every such vehicle shall hereafter be referred to as an eligible vehicle.
   B.   Liability: The registered owner or owners (collectively the "owner") of an eligible vehicle shall be presumed to have been the registered owner at the time that each unpaid citation was issued, and each such owner shall be jointly and severally liable and responsible for all applicable immobilization, towing, and impoundment fees imposed pursuant to this Chapter; provided, however, that no such presumption of liability shall be made for any such citation if, at the time that such citation was issued, the eligible vehicle was being operated without the owner's knowledge and consent.
