4-5-3: ABATEMENT OF NUISANCE:
It shall be the duty of the owner or occupant of any land upon which such diseased or infested tree or part thereof exists, to have the same removed and destroyed within thirty (30) days of notice by the village clerk or designee that such tree or part thereof is so infected or infested. If the said owner or occupant does not properly remove and dispose of such infected or infested tree or part thereof within thirty (30) days after such notice, the director of public services is authorized to remove and destroy such infected or infested tree. The notice provided for in this section shall be personally served or sent by registered mail to the person to whom was sent the tax bill for the general taxes for the last preceding year on the property, and such notice is to be delivered or sent not less than thirty (30) days prior to any removal of the tree or part thereof by the village. Such notice shall set forth the duty of the property owner or occupant to remove the tree and it shall further provide that if the tree is not removed within thirty (30) days, it will be removed by the village and the cost of removal will be charged to the property owner and a lien will be filed with the recorder of deeds against the property in the amount of the cost incurred.
