(A) Whoever violates any provision of this chapter shall be guilty of a misdemeanor and shall, upon conviction, be fined not more than five hundred dollars ($500).
(B) Violation of any provision of § 91.09 shall constitute a civil violation subject to a civil fine of $50 for the first offense, $100 for the second offense, and $150 for all other offenses. The fine shall increase by $125 should the citation be contested and a hearing before the Hillview Code Enforcement Board be requested. Failure to obtain the required permit shall further result in a stop work order prohibiting any encroachment upon a city-maintained street until such time that an application is approved, and a permit is issued.
