(A) Fees to be charged and procedure for determining the same.
(1) If the landowner fails to remove such weeds and/or rank vegetation within the time prescribed by the applicable ordinance as passed by the Town Council, the town may remove such weeds and rank vegetation.
(2) The Clerk-Treasurer shall make a certified statement of the actual cost incurred by the city in such removal.
(3) Said certified statement shall be delivered to the owner of such real estate by the Town Marshal and/or Town Deputy Marshal, or by registered mail.
(4) Such owner shall have not more than ten days within which to pay said amount to the Clerk-Treasurer of the town.
(5) For the costs incurred for town manpower and the use of town equipment for the removal of noxious weeds and vegetation, the following fees shall be established:
(a) Thirty dollars per hour per employee;
(b) For the use of town equipment the following:
Backhoe | $60 per hour |
Bobcat | $60 per hour |
Dump truck | $60 per hour |
Riding lawn mower | $30 per hour |
Walking mower and weed eater | $15 per hour |
(c) There shall be a three-hour minimum charge for the use of each employee and the use of equipment.
(B) Procedure for collection when there is non-payment.
(1) If such owner fails to pay said sum within the time prescribed, a certified copy of the statement of costs shall be filed within the Office of the County Auditor where said real estate is located.
(2) The Auditor shall place the amount so claimed on the tax duplicate against the lands of the landowner affected by said work.
(3) The same shall be collected as taxes are collected, and when so collected shall be disbursed to the General Fund of the town.
