7-4-18: USE OF WIRELESS TELEPHONES AND ELECTRONIC DEVICES WHILE OPERATING A MOTOR VEHICLE:
   A.   Definitions: For purposes of this section, the following terms shall be applicable:
    ELECTRONIC DEVICE: Any electronic device, including, but not limited to, a wireless telephone, personal digital assistant, or a portable or mobile computer while being used for the purpose of composing, reading, or sending an electronic message, but does not include a global positioning system or navigation system or a device that is physically electronically integrated into the motor vehicle.
   HANDS FREE DEVICE: An external device that connects to a mobile telephone that allows the user to engage in a telephone call without touching the user's mobile telephone.
   USE OR USING: Talking or listening to another person, text messaging, sending, reading or listening to an electronic message, or browsing the internet.
   WIRELESS TELEPHONE: A cellular, analog, wireless or digital telephone capable of sending or receiving telephone messages without an access line for service.
   B.   Use Of Wireless Telephones And Electronic Devices While Driving Prohibited: Except as otherwise provided in subsection C of this section, no person shall operate a motor vehicle while using any wireless telephone or electronic device.
   C.   Exceptions: The provisions of this section shall not apply to:
      1.   Any person using a hands free device for voice communication, provided that person does not touch the wireless telephone or electronic device connected to such hands free device while operating or using the vehicle.
      2.   Any person using a wireless telephone or electronic device for purposes of contacting or communicating with public safety or other emergency service providers while driving a motor vehicle.
      3.   Any person using a wireless telephone or electronic device while maintaining a motor vehicle in a parked position.
      4.   Any law enforcement officers and operators of emergency vehicles when on duty and acting in their official capacities. (Ord. 13-O-28, 5-7-2013)
