7-4-17: SAFE CARRYING OF PASSENGERS:
   A.   Definition: The term "vehicle", as used in this section, shall have the meaning defined in the Illinois vehicle code, as amended, or as may be defined in any successor statute.
   B.   Scope: The provisions of this section shall apply to all areas and parts of vehicles, whether interior or exterior.
   C.   Prohibitions:
      1.   No person or persons shall occupy a house trailer while it is being moved upon a public street or highway.
      2.   No person or persons shall occupy any area or part of a vehicle designed or intended for pulling or carrying of property, freight or cargo while such vehicle is being moved upon a public street or highway.
      3.   No person or persons shall occupy any area or part of a vehicle not designed or intended for the carrying of passengers while such vehicle is being moved upon a public street or highway.
   D.   Approved Seating Areas: An area of a motor vehicle which is equipped with a seat designed or intended for carrying of passengers and where required by the Illinois vehicle code, as amended, seat safety belts shall be proper for carrying of passengers under this section.
   E.   Violation Prohibited; Responsibility For Violation: No person shall drive or move any vehicle upon a public street or highway while passengers occupy any area in violation of this section. The driver of each vehicle shall be responsible to assure compliance with all the provisions of this section prior to commencing movement upon a public street or highway.
   F.   Prima Facie Proof: The fact that the number of passengers occupying a vehicle exceeds the maximum number of passengers stated in the manufacturer's specifications shall be prima facie evidence that one or more violations of this section have occurred. (Ord. 92-O-24, 5-5-1992)
