7-4-13: TRUCK TRAFFIC:
   A.   Prohibited On Designated Streets; Exceptions:
      1.   Vehicles exceeding eight thousand (8,000) pounds' registered gross weight or bearing a state of Illinois vehicle license, class D or over, or any comparable class license issued by any other state, are prohibited from movement upon the following named streets:

Michigan Avenue
Between the eastern city limits and the western city limits
Washington Avenue
Between Green Bay Road and Western Avenue
Western Avenue
Between the northern city limits and the southern city limits
 
      2.   Vehicles bearing a state of Illinois vehicle license, class L or over, or any comparable class license issued by any other state, are prohibited from movement upon the following named streets:
 
Street
Location
Lyster Road
At any point
Ronan Road
At any point

      3.   The prohibitions established in this subsection shall not apply to the following vehicles:
         a.   Vehicles making deliveries to or pick ups from property accessible only via streets designated as "no truck" streets pursuant to this subsection, unless said vehicle bears a state of Illinois vehicle license, class S or over, or any comparable class license issued by any other state; or
         b.   Vehicles operated on behalf of public utility companies for the purpose of carrying out utility functions to service property accessible only via streets designated as "no truck" streets pursuant to this subsection, within the city; or
         c.   School buses; or
         d.   Emergency vehicles when operating in the line of duty. (Ord. 2006-O-8, 3-7-2006)
   B.   Trucks In Alleys: It shall be unlawful for any vehicle with a gross weight in excess of six (6) tons to operate or park in any alley within the city. (Ord. 77-O-9, 9-16-1977)
   C.   Tractors And Trailers: All road tractors operated in combination with a trailer or semitrailer shall be prohibited from movement upon the streets of the city unless the operator displays in the windshield of the road tractor a temporary use permit as defined in subsection D of this section. This prohibition shall not apply to emergency vehicles when operating in the line of duty. (Ord. 90-O-9, 5-15-1990; amd. Ord. 2006-O-8, 3-7-2006)
   D.   Permit Requirements:
      1.   Temporary street use permits may be granted by the mayor, chief of police or any member of the police department authorizing the movement on city streets by any vehicle otherwise prohibited by this section.
      2.   Application for a temporary street use permit shall be made by the owner or operator of the vehicle or vehicles which will be the subject of the permit, or by the owner of any property within the city to or from which such vehicles will be traveling, and shall include all information which the mayor or chief of police shall, from time to time, deem appropriate but shall, in any event, include at least the following information:
         a.   Name and address of applicant;
         b.   Name and address of the owner of the vehicle or vehicles which will be the subject of the permit;
         c.   The state of Illinois or other state vehicle license number of the subject vehicle or vehicles;
         d.   A specific description of the vehicle or vehicles and load to be operated or moved and whether such permit is requested for a single trip or for limited continuous operation and date or dates of such trip or limited continuous operation;
         e.   The points of origin and destination of the subject vehicle or vehicles;
         f.   Whether the vehicle or vehicles are being operated for hire; and
         g.   The route or routes over which the applicant desires to operate the subject vehicle or vehicles.
      3.   The mayor, chief of police or any member of the police department may issue such temporary street use permits upon determining that the proposed street use is not inconsistent with traffic safety and maintenance of the structural integrity of the city streets. Where a permit is issued, the issuing officer may impose on such grant any conditions deemed appropriate to the protection of the public safety and the structural integrity of all city streets including, but not limited to, the following:
         a.   Description of the route or routes to be traveled.
         b.   Establishment of season, weather condition or time limitations on such operation.
         c.   Restriction on the size and type of loads which may be moved by virtue of such permit.
         d.   Description of appropriate safety measures and methods of securing loads.
      4.   In no event shall the mayor, chief of police, or any member of the police department issue a temporary street use permit for a period exceeding fourteen (14) days.
      5.   During the term of such permit, the person to whom such permit is issued and the owner and operator of the vehicle covered by the permit shall be responsible for keeping all city streets used by such vehicle free and clear of all dirt, mud, obstructions and hazards resulting from such use and shall repair such damage thereby caused as may be necessary to keep routes for which a permit has been issued in a reasonable state of repair for normal and safe use. At the termination of the period for which such permit was issued, such persons shall be responsible for causing all streets over which the subject vehicles traveled to be restored to their condition prior to such use.
      6.   The issuing officer may, as a condition to the issuance of a temporary street use permit, require any applicant to post a bond, in an amount to be established by the mayor or chief of police and in a form satisfactory to the city attorney, to guarantee the adequate repair and restoration of all streets over which travel is authorized by such permit.
      7.   Any temporary street use permit granted pursuant to this subsection may be revoked by the mayor or chief of police or any member of the police department if the person to whom the permit has been issued, or any person acting on his behalf, violates any of the terms of the permit, any terms of this section, or the terms of any other applicable ordinance, or where the safety of pedestrian or vehicular traffic or the structural integrity of city streets so require. Any such revocation may be appealed to the mayor and city council for final determination.
      8.   The granting of a temporary use permit shall be in the sole discretion of the mayor or chief of police. Nothing in this subsection shall be construed as granting to any person, firm, corporation or entity any right to the issuance of such a temporary permit. (Ord. 90-O-9, 5-15-1990)
      9.   Fees for temporary street use permits issued pursuant to this subsection shall be as provided in section 3-2A-1 of this code. (Ord. 90-O-9, 5-15-1990; amd. 2009 Code)
   E.   Signs Posted: The department of streets shall cause signs to be posted at all appropriate locations within the city bearing the universal "no truck" legend and a legend similar to the following: "No Semitrailer Trucks - Special Permit Required". (Ord. 90-O-9, 5-15-1990)
