6-1-3: DISPOSITION OF SIDEARMS:
   A.   Disposition At Retirement: In the event an officer retires from the city police department, upon such retirement and upon the request of such officer, the officer's sidearm duty weapon may be transferred to the officer as a token of the city's appreciation for the officer's years of service.
   B.   Obsolete Sidearms: Any sidearms which are determined to be obsolete and no longer serviceable for duty are hereby declared to be surplus property of the city. Such sidearms may be made available by the chief of police to officers in the department as collectibles. Any officer receiving such a sidearm shall be eligible to receive same including possessing all necessary state, federal or other permits, and the officer shall sign a receipt for the sidearm.
   C.   Protocol: The chief of police shall establish a protocol and procedure for availability and distribution of such sidearms including, at a minimum, the following:
      1.   That prior to distribution, the chief certifies to the mayor that the type, model, and serial number of the sidearm intended to be disposed of, providing no less than thirty (30) days' notice to the mayor. In such certification, the chief shall certify that such sidearm is obsolete for police department purposes, is surplus property of little or no value to the city and the chief's proposed disposition of same.
      2.   That upon receipt of such certification and expiration of the thirty (30) day time period, such sidearm shall be deemed to be surplus city property unless the mayor delivers a notification to the chief of police that the sidearm shall not be disposed of as proposed by the chief, but rather shall be disposed of in another manner to be determined by the city council.
      3.   That any officer receiving such a sidearm shall be eligible to receive same, including possessing all necessary state, federal or other permits.
      4.   That the officer shall sign a receipt for the sidearm.
   D.   Compliance With Other Regulations: In the disposition of any sidearms, the city police department shall otherwise comply with all applicable federal, state and other ordinances and regulations. (Ord. 2004-O-39, 5-4-2004)
