A. Ranks Established: The order and rank and filling of vacancies shall be determined by the municipal budget at approval of the City Manager.
1. One chief of police; and
2. No more than two (2) sergeants of police; and
3. A maximum of nine (9) full time patrol officers.
B. Duties:
1. Chief Of Police: The chief of police shall perform such duties as are prescribed by his oath of office, the mayor, the statutes of the state, the ordinances of the city, any applicable employment agreement and the rules and general orders of the police department.
2. Sergeants Of Police: Sergeants of police shall perform such duties as are prescribed by their oaths of office, the mayor, the statutes of the state, the ordinances of the city, the chief of police, the deputy chief of police (if any), the lieutenants of police (if any), and the rules and general orders of the police department.
3. Patrol Officers: Patrol officers shall perform such duties as are prescribed by their oaths of office, the mayor, the statutes of the state, the ordinances of the city, the chief of police, the deputy chief of police (if any), any lieutenant of police, the sergeants of police (if any) and the rules and general orders of the police department.
C. Testing For Appointment Or Promotion: The board of fire and police commissioners shall test for appointment to and/or promotion to the aforesaid ranks (other than the rank of chief of police or deputy chief) when vacant.
1. The City shall conduct a promotional process for appointment to and/or promotion to the aforesaid ranks (other than the rank of Chief of Police, Deputy Chief, or Commander) when vacant, and upon direction of the City Manager.
2. All promotions shall made from the three (3) individuals having the highest rating on the final promotional list. This promotional list will remain valid for three (3) years from date of posting.
3. Testing for the ranks of Sergeant and Lieutenant - a promotional list will be created based upon scores complied from the following criteria:
a. A minimum five (5) years full-time police service is required to participate in any promotional testing.
b. Participants shall receive one point for full-time police experience for every two (2) years (beyond the required minimum five). Maximum of six (6) points.
c. Oral interview with the BoFPC. Maximum of seventy (70) points.
d. Three (3) points for previous police supervision.
e. Educational points - four (4) year degree (four (4) points), advanced degree (additional two (2) points).
f. Points will be applied for performance and efficiency. Maximum of ten (10) points.
g. Chief of Police merit, maximum of five (5) points.
4. Within a reasonable amount of time (not to exceed sixty (30) days) after the completion of the promotional examination process, the Board shall prepare, certify and post an eligibility register of candidates who shall be ranked in the order of their relative excellence, as determined by the examination process and the application of departmental merit and efficiency considerations, as hereinabove provided. An average grade of seventy-five percent (75%) of the cumulative sum shall be required for listing on said register.
5. The eligibility register shall be posted and all candidates who are deemed eligible shall be notified thereof.
6. The Police Chief shall select a candidate to be promoted from among the three (3) highest ranked candidates on the applicable eligibility list. At the time of such promotion, the selected candidate must be mentally and physically able to perform the essential functions of the position. Board approval shall be necessary for the Police Chief to promote a candidate ranked either second or third on the eligibility list in lieu of promoting the candidate to his ranked first. The eligibility register shall remain in effect for a period of three (3) years from the date of posting, unless said eligibility register is exhausted prior thereto. No person shall accrue any property right to a particular position upon the eligibility register, and no person shall accrue any property right to promotion based upon position upon the eligibility register. Officers may be removed from the eligibility register when, in the opinion of the Board, circumstances justify such removal.
D. Additional Officers: Upon authorization of the mayor, the chief of police may hire and/or appoint part time patrol officers, auxiliary officers, community service officers, and temporary officers as may be necessary or convenient for the safe and efficient operation of the city and to ensure the public health, safety and welfare. Such officers shall perform such duties as are prescribed by their oaths of office, the mayor, the statutes of the state, the ordinances of the city, the chief of police, the deputy chief of police (if any), any lieutenant of police and the rules and general orders of the police department.
1. Part time patrol officers shall be subject to the following provisions:
a. Authority Of Chief Of Police: The chief of police is authorized to appoint, discipline and discharge all part time patrol officers, subject to the advice and consent of the mayor. Part time patrol officers shall be members of the regular police department except for pension purposes. Part time patrol officers shall, at all times during the performance of their duties, be subject to the direction and control of the chief of police.
b. Hiring Standards: Candidates must be at least twenty one (21) years of age, possess a high school diploma or GED equivalent, possess a valid driver's license, be a U.S. citizen and have no prior felony convictions. Prior to being hired, a part time patrol officer must have previous law enforcement experience or must obtain certification within eighteen (18) months after the date of hire, according to 50 Illinois Compiled Statutes 705/8.2. The applicant must also have a screening and background check, which includes a fingerprint check through the Illinois criminal history and federal bureau of investigation (FBI), pass a medical exam, and any further tests deemed necessary by the chief of police based upon the applicant's experience and prior training. Further, any individual who has served in the military must have been honorably discharged.
c. Training Standards: The part time patrol officer, upon hiring by the city, shall be trained in accordance with the intergovernmental law enforcement officer's in-service training act, 50 Illinois Compiled Statutes 720/1 through 6, and any other rules and requirements of the ILETSB.
d. Powers And Duties: A part time patrol officer shall have all the powers and duties as a regular member of the police department, but shall not be assigned under any circumstances to supervise or direct full time police officers of the city. Part time patrol officers shall not be used as permanent replacements for permanent full time officers. Part time patrol officers must abide by all rules, regulations, policies and general orders as set forth by the chief of police and the city.
e. Hours: A part time patrol officer shall not work in excess of one thousand five hundred sixty (1,560) hours per calendar year.
2. Auxiliary police officers shall be subject to the following provisions:
a. Appointment: The chief of police of the city of Highwood may appoint auxiliary police officers in such a number as deemed necessary from time to time, with advice and consent of the mayor.
b. Duties And Restrictions: Auxiliary police officers shall not be members of the regular Highwood police department, shall not be used to replace full time or part time sworn officers of the Highwood police department, and shall not supplement members of the regular Highwood police department in the performance of their assigned and normal duties, except as provided herein. Auxiliary police officers shall only be assigned to perform the following duties in the city:
(1) To aid with or direct traffic,
(2) To aid with or direct crowd control,
(3) To aid in control of natural or manmade disasters, and
(4) To aid in case of civil disorder as directed by the police chief; provided, that in cases which render it impractical for members of the regular police department to perform the normal and regular police duties, the police chief is hereby authorized to assign auxiliary police officers to assist sworn police officers in the performance of those sworn police officers' normal and regular police duties in a case of civil disaster.
c. Identification: Identification symbols including a badge and uniform worn by such auxiliary police officers shall be different and distinct from those used by members of the regular Highwood police department.
d. Supervision: Such auxiliary police shall at all times during the performance of their duties be subject to the direction and control of the police chief, or of the superior officer in charge during such period of duty.
e. Firearms: The auxiliary police officers shall not carry firearms, except with the permission of the police chief and while in uniform and in the performance of their duties, and only after completing the forty (40) hour mandatory firearms training course as provided under section 2 of the peace officer firearm training act 1 .
f. Training: Auxiliary police officers shall be trained in accordance with all Illinois law enforcement training and standards board requirements.
g. Conservators Of The Peace: Auxiliary police officers, when on duty, shall not be conservators of peace, and shall not have the powers (including arrest powers) as specified in 65 Illinois Compiled Statutes 5/3.1-15-25.
h. Hiring Standards: No person shall be hired as an auxiliary police officer who has not been fingerprinted, subject to background check, and found to have never been convicted of a felony or other crime involving moral turpitude. Auxiliary police officer's must be at least twenty one (21) years of age, have a high school diploma or GED equivalent, and hold a valid Illinois driver's license.
