4-19-5: DEFINITIONS:
For purposes of this chapter, terms used herein are defined as follows:
BUSINESS: Any for profit or not for profit entity, including, without limitation, any sole proprietorship, partnership, corporation, joint venture, association, franchisee, or cooperative that leases or owns space within a building, located in the city for the primary purpose of carrying on such business. Businesses that operate from distinct spaces or buildings with separate addresses shall be deemed to be separate businesses regardless if such businesses are owned or operated by the same sole proprietorship, partnership, corporation, joint venture, association, franchisee or cooperative.
ENGAGING IN BUSINESS: Persons operating, conducting, doing, carrying on, causing to be carried on, or pursuing any business, profession, occupation, trade, pursuit or activity for the purpose of profit.
LICENSE: A privilege granted by the city after the fulfillment of all conditions precedent that are expressly provided herein. Every license granted by the city pursuant to this chapter, and every renewal thereof, shall be purely a personal privilege, shall not constitute property, and shall not otherwise be construed in any manner to create any other right or interest to such license.
OWNER: Any individual, firm, association, partnership, corporation, trust, or any other legal entity having sufficient proprietary interest in any establishment to maintain and manage its operation.
PERSON: Any individual, firm, association, partnership, corporation, trust, or any other legal entity, except for such person or persons as may be organized as an Illinois not for profit corporation, or any governmental body properly organized under the law of the state of Illinois.
PLACE OF BUSINESS: The premises (except a personal residence), main business location or an outlet, branch or other location thereof, temporary or otherwise, to which the public is expressly or impliedly invited for the purpose of transacting of business. In the event there is no such location, but the business is transacted at the location of the buyer, then the general sales area shall be considered a place of business. Place of business shall not include a business conducted at a personal residence. (Ord. 12-O-38, 8-21-2012)
