SECTION 6.06.01 POWERS AND DUTIES.

The Board shall meet at the call of its Chairman to hear and determine appeals filed from decisions of the Planning and Zoning Commission. The Board shall review all records of the Planning and Zoning Commission pertaining to a matter appealed and shall render a decision on all appeals within forty five (45) days from the date of filing same with the Secretary of the Board. The Board may affirm, amend or supersede a decision of the Planning and Zoning Commission. Decisions of the Board shall be based upon facts set forth in writing which shall become a part of the public record.

Decisions of the Board of Building and Zoning Appeals shall be final within the Municipality, except that an appeal therefrom may be taken to any court of record in accordance with the laws of the State of Ohio by any proper and interested party including the Municipality. (Amended 11-6-90)
