909.05 CONSTRUCTION OF SIDEWALKS REQUIRED BY CITY; PERMIT FEES; EFFECTIVE DATE.
   When the City declares its intent to construct sidewalks on existing residential premises and to assess the cost therefor against the abutting property owner, whether in whole or in part, then any owner of property who elects to construct his own sidewalk to avoid such assessment shall be charged only one dollar ($1.00) for the permit fee required by Section 909.02 and shall not be charged the line and grade setting fee required by Section 909.03. This section shall be retroactive to July 15, 1982 and the owner of any residential property who, under the circumstances governed by this section, elected to construct his own sidewalk to avoid an assessment and who paid any amount in excess of the fee required by this section
shall be entitled to a refund of any amount paid by him in excess of the fee required by this section. Application for such refund shall be made to the Building Commissioner at any time following the effective date of this section.
