905.03 MANNER OF WORK AND RESTORATION.
   Openings and excavations in dedicated streets, rights of way, and/or public easements shall be made and restored as required by the City Engineer, the Service Director or their designee and in the following manner:
   (a)    All openings and excavations and the backfilling and restoration thereof and all work zones shall comply with all laws, guidelines and practices as set forth in the most recent version(s) of; the Ohio Revised Code; the Ohio Department of Transportation (ODOT) Construction and Materials Manual; the Ohio Manual of Uniform Traffic Control Devices (OMUTCD); the Cuyahoga County Uniform Standards for Sewerage Improvements; and the Ohio Utility Protection Service (OUPS) except as allowed or directed by the City Engineer and/or the Service Director or their designee and/or in the case of maintenance of traffic, by any member of the Police Department.
   (b)   All streets, public property, and lawfully installed improvements therein which are disturbed by the permittee’s activity shall be restored to the Municipality’s satisfaction in the time frame prescribed by the Municipality, or if not prescribed by the Municipality, as soon as possible (in no circumstances more than thirty (30) days from the date of completion of construction) by the permittee, at its expense, to, at a minimum, the condition which existed prior to construction, all to the Municipality’s satisfaction. In the event replacement and restoration of the area is not completed within thirty (30) days or as soon as reasonably possible, the Municipality may, upon written notice to the permittee, complete any necessary work at the sole expense of the permittee. The Municipality may utilize the proceeds of the bond provided for in Section 1311.14 to restore any disturbed area where the permittee fails to timely undertake or complete such restoration.
