1311.14 STREET OPENING PERMIT FEES AND DEPOSITS.
All applications for a street opening permit shall be accomplished by the following application fees and deposits:
(a) Permit fee $200.00
(b) An inspection and review deposit fee as determined by the City Engineer or Service Director for inspection and/or professional review shall be not less than $350.00 nor greater than $10,000.00. The Director of Finance is hereby authorized to notify and invoice the permittee in the event that inspection and review fees exceed deposits on hand and to refund to the permittee any balance of deposits less fees upon satisfactory completion and restoration of all disturbed areas.
(c) In addition to the permit fee and the inspection and review fee required hereunder, the contractor shall post a cash bond as determined by the City Engineer or Service Director of not less than $1,000.00 as a guarantee the replacement work contemplated herein remains in satisfactory condition as determined by the City Engineer or Service Director for a period of not less than 180 days.
In the event replacement and restoration of the area is not completed within thirty (30) days or as soon as reasonably possible, the Municipality may, upon written notice to the permittee, complete any necessary work at the sole expense of the permittee. The Municipality may utilize the proceeds of the bond provided to restore any disturbed area where the permittee fails to timely undertake or complete such restoration.
