   1301.01 CURRENT EDITIONS ADOPTED.
   (a)   Pursuant to Ohio R.C. 731.23.1, there is hereby adopted for the Village, the current edition of the International Building Code as modified by the State of Ohio and titled the “Ohio Building Code” in accordance with 4101:2-1-03 titled the “Ohio Building Code” of the Ohio Administrative Code in its entirety and any modifications or additions thereof adopted by the Ohio Board of Building Standards as authorized by Administrative Code 4101:2-1-04 titled “Authority to Adopt”.
   (b)   There is further adopted for the Village the International Mechanical Code as amended and modified by the State of Ohio Board of Building Standards per the Ohio Administrative Code 4101:2-1-01.1. Chapters 4101:2-1 to 4101:2-15 of the Administrative Code shall be designated as the “Ohio Mechanical Code” for which the designation “OMC” may be substituted. “Supplements to the International Code” with errata and editorial changes provided to the publishers of the “Ohio Mechanical Code” as of the adoption date of this rule are incorporated as if set out at length with substitutions. References to these chapters, to “this Code”, or to the “Mechanical Code” in other sections of the Ohio Administrative Code shall mean the “Ohio Mechanical Code”. The scope of this code shall regulate the design, installation, maintenance, alteration, repair, relocation, replacement, addition to, use and inspection of mechanical systems that are permanently or temporarily installed and utilized to provide control of environmental conditions and related processes within or without buildings. This Code shall also regulate those mechanical systems, system components, equipment and appliances specifically addressed herein.
   (c)   There is further adopted for the Village the International Plumbing Code as amended and modified by the State of Ohio Board of Building Standards per the Ohio Administrative Code 4101:3-1-01.1. Chapters 4101:3-1 to 4101:3-13 of the Ohio Administrative Code shall be designated as the “Ohio Plumbing Code” for which the designation “OPC” may be substituted.
   (d)   The “International Plumbing Code 2000, first printing, Chapters 2 to 13", as published by the International Code Council, Inc., and the March 2001 “Supplement to the International Codes” with errata and editorial changes provided to the publishers of the Ohio Plumbing Code as of the adoption date of this rule, and all editions adopted hereafter, are incorporated fully as if set out at length with substitutions as set forth below. References in these chapters to “this code” or to the “plumbing code” in other sections of the Ohio Administrative Code shall mean the “Ohio Plumbing Code”. The scope of this code shall regulate the design, installation, maintenance, alteration, repair, relocation, replacement, addition to, use and inspection of plumbing systems and equipment.

   1301.02 COMPLIANCE; VIOLATIONS.
   (a)   No owner or any other person shall construct, erect, build or equip any building or structure to which the OBC is applicable, or make any addition thereto or alteration thereof, except in the case of repairs or maintenance that does not affect the construction, sanitation, safety or any other vital feature of such building or structure, without complying with this chapter, Ohio R.C. Chapters 3781 and 3791 or the OBC, or fails to comply with any lawful order issued pursuant thereto. (ORC 3791.01, 3791.02)
   (b)   No architect, builder, engineer, plumber, carpenter, mason, contractor, subcontractor, foreman or employee shall violate or assist in violating any of the provisions of this chapter, Ohio R.C. Chapters 3781 and 3791 or the OBC, or fail to comply with any lawful order issued pursuant thereto. (ORC 3791.01, 3791.03)
   (c)   No owner or any other person shall proceed with the construction, erection, alteration or equipment of any building or structure to which the OBC is applicable without complying with this chapter and the plan and specification submission and processing requirements of the Municipality, and until plans or drawings, specifications and data have been approved or the industrialized unit has been inspected at the point of origin.

   1301.03 AMENDMENTS.
   The following amendments hereinafter become a part of the Ohio Building Code, the Ohio Mechanical Code, or the Ohio Plumbing Code, as indicated:
Work Exempt from Permit. That Section 105.2 entitled “Work Exempt from Permit” contained within the Ohio Building Code is hereby deleted from its adoption by reference in this Chapter 1301.

   1301.99 PENALTY; EQUITABLE REMEDIES.
   Whoever violates or fails to comply with any of the provisions of this chapter, including any provision of the OBC adopted in Section 1301.01, is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. Unless otherwise provided, a separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues. (Ord. 2006-38. Passed 9-13-06.)
