709.04 RULES AND REGULATIONS; AUTHORITY OF GUARDS; FEES; BOND AND INSURANCE.
   (a)   The Mayor is hereby authorized to promulgate such rules and regulations as he or she deems necessary to carry out the purposes of this chapter. Proposed rules and regulations and amendments thereto shall be filed with the Clerk of Council, and letters noticing this fact shall be sent to each Councilman. Such rules and regulations shall take effect on the thirtieth day following the filing with the Clerk, unless prior to such day Council adopts a resolution of disapproval.
   (b)   The Mayor may designate the property or the geographical area of the Village within which an armed security guard so commissioned by the Village may exercise his or her authority. Each armed security guard so commissioned has the power to arrest a person committing a misdemeanor in his or her presence, and such other authority as the Mayor may direct by the rules and regulations mentioned in subsection (a) hereof, subject to all ordinances and all applicable State and Federal laws.
   (c)   Unless excepted under Section 709.01(c), each armed security guard shall give bond, by a bonding company authorized to do business in the State, in the sum of five thousand dollars, ($5,000.00) to the satisfaction of the Mayor and the Director of Law, and shall pay a license fee in an amount as provided in Chapter 105 for the first year and a renewal fee in an amount as provided in Chapter 105 for each year thereafter.
   (d)   Any applicant for an armed security guard commission who has failed after three attempts to pass the weapons qualification test provided for in Section 709.09 shall be assessed a fee in an amount as provided in Chapter 105 for each subsequent attempt to pass the test.
   (e)   Unless excepted under Section 709.01(c), each private security service shall submit evidence of comprehensive general liability insurance coverage, as provided in Ohio R.C. 4749.03(A)(4), and shall pay a license fee in an amount as provided in Chapter 105 for the first year and a renewal fee in an amount as provided in Chapter 105 for each year thereafter.
   (f)   Each armed security guard or private security service currently licensed pursuant to Ohio R.C. Chapter 4749 shall not be required to pay the license fee required by subsections (c) and (e) hereof, except as authorized by Ohio R.C. 4749.09.
