6-2-8: VIOLATION; PENALTIES:
Any violation of this chapter is declared to be and constitutes a nuisance. Any person, firm or corporation violating any of the provisions of this chapter shall be fined not less than twenty dollars ($20.00) nor more than seven hundred fifty dollars ($750.00) for each offense 1 . A separate offense shall be deemed committed on each day that said violation continues. If any animal is taken to an animal shelter, the owner shall pay the animal shelter release fee. For all subsequent offenses, the alleged violator hereof shall pay the shelter release fee, plus be charged with a violation of this chapter.
In addition to the requirements herein imposed, any person who harbors or feeds feral or stray cats shall receive a 30-day warning to cease and desist on feeding the feral cats and such person comply with the requirements set forth in Section 6-2-5-7(B) above. Failure to gain compliance within 30 days shall result in a Two Hundred Fifty Dollar ($250.00) fine. Failure to gain compliance within 60 days shall result in a Five Hundred Dollar ($500.00) fine. Failure to gain compliance within 90 days shall result in a Seven Hundred Fifty Dollar ($750.00) fine. (Ord. 2008-37, 11-3-2008; amd. Ord. 2023-51, 11-2-2023)
