§ 94.05  DOGS PROHIBITED FROM RUNNING LOOSE, IMPOUNDING.
   (A)   It is hereby declared to be a nuisance for any dog to run at large at any time within the corporate limits of the village with or without a collar. Such dogs may be taken up by the Animal Control Officer and placed in the Village Kennel.
   (B)   The owner of any dog taken by the Animal Control Officer to the Village Kennel for the first time may redeem his dog at no charge if the dog has been registered with the county and has had the vaccinations required by law.
   (C)   A fee of $25 must be paid to the Village Clerk for a second occasion the same dog is taken to the Village Kennel; $50 for a third occasion; $75 for a fourth occasion and an additional $25 for each succeeding occasion.
   (D)   The owner of a dog taken to the Village Kennel shall not be allowed to take possession of the dog after paying the appropriate fee if the dog has not been registered with the county and/or has not had the required vaccinations. All such dogs will be taken by the Shelby County Animal Control Officer to the County Pound. The owner will then be required to redeem the dog from the county.
   (E)   All dogs that have been taken to the Village Kennel afer regular business hours of the Village Clerk cannot be redeemed by the owner until the following day; provided however, that any dog taken to the Village Kennel after hours on Friday or a holiday may not be redeemed by the owner until the next business day of the Village Clerk.
   (F)   Any dog taken to the Village Kennel sowing evidence of mistreatment, starvation or improper shelter shall be taken by the Shelby County Animal Control Officer to the County Pound. The owner will be required to redeem the dog from the county.
