A. The provisions of this Chapter shall not apply to:
1. The operation of any barbecue equipment.
2. Fires set or permitted by any public agency in the performance of its official duty for the purpose of weed abatement, prevention or elimination of a fire hazard, public health or safety hazard or instruction of employees in the method of firefighting.
B. The Morrow County School District and Pioneer Memorial Hospital shall be granted exemptions to this Chapter for materials burned in the incinerators located at Heppner High School, Heppner Middle School and Pioneer Memorial Hospital, provided the entities meet the following conditions:
1. No hazardous materials shall be burned in any incinerator.
2. The entity shall comply with Oregon Department of Environmental Quality restrictions on materials that may be burned in the incinerators.
3. The entities will screen the incinerators to prevent burning materials from escaping.
4. No other person or entity shall be allowed to burn materials in the incinerator owned by the entity.
5. The incinerator shall be approved by the Fire Chief before any burning.
6. The incinerator shall be certified annually by the Fire Chief. (Ord. 497-93, 8-9-93; 1995 Code)
