§ 50.05 CONTAINERS.
   (A)   Required. No person shall deposit or place any garbage or trash in any alley, street or other public place within the town, nor shall any person deposit or place it upon private property, whether owned by such person or not, within the limits of the town, unless the same shall be enclosed in a suitable container.
   (B)   Location.
      (1)   Accessibility. Garbage and trash containers shall be located at a single place on each premises, which place shall be easily accessible to the street or alley from which the collections are made. The town reserves the right to refuse to collect garbage and trash from containers which are not easily accessible, and do not meet the requirements of this chapter.
      (2)   Downspouts. Garbage and trash containers shall not be located directly under downspouts or eaves where they will be deluged with water during storms.
      (3)   Accumulation unlawful. It shall be unlawful for any owner, occupant or other persons in charge of any lot, tract of ground or other premises in the town to allow garbage or trash to accumulate thereon and to permit water or other putrid substances, whether animal or vegetable, to so accumulate as to cause an offensive odor to be emitted therefrom or to cause a condition dangerous to the health of any person.
   (C)   Standards.
      (1)   The standard refuse container required by this chapter shall be a receptacle of not more than 35 gallons or less than ten gallons’ capacity, of impervious material and sturdy construction, with a tight-fitting cover, equipped with at least two handles properly spaced to facilitate handling, and shall be subject to the approval of the Board of Trustees, or plastic bags manufactured to be used as garbage containers.
      (2)   If one container is not sufficient to hold the quantity of garbage and trash accumulated between collections, a sufficient number of containers shall be provided.
      (3)   All commercial establishments and institutions shall furnish a metal dumpster type container if three 35-gallon containers are not sufficient to hold the quantity of garbage, trash and solid waste accumulated between collections.
