§ 150.196 BOARD OF REVIEW; CONSENT OF ADJACENT PROPERTY OWNERS.
   (A)   Board consider recommendations. Upon the consideration of any application for a permit required by the terms of this chapter, the oil and gas inspector shall recommend approval or disapproval thereof to the Mayor and Town Board of Trustees, who shall review the matter at a town meeting, and thereupon uphold or reverse the recommendation with or without the addition of any conditions thereto.
   (B)   Adjacent property owners, written consent. The application for a permit shall be accompanied by the written consent of each owner of an existing dwelling house, building or other structure designed for occupancy of human beings or animals, which house, building or structure is within 300 feet of any such well, as shown in the application § 150.194(A)(2) of this subchapter. The Town Board may not approve the application without such consent.
