§ 52.16 BACKFLOW PREVENTER VALVES.
   (A)   Backflow preventer valve required. A backflow preventer valve (approved by the Town Administrator or his or her delegate) is required to be installed on all new and replaced sanitary sewer lines for any residence, commercial building or other structure.
   (B)   Location of backflow preventer valve.   A backflow preventer valve shall be installed so that access is provided to the working parts for service and repair. If installed under concrete or asphalt paving such as sidewalks, driveways or parking areas, the valve shall be installed in a permanent box or access enclosure whose lid is flush with grade. If installed under soil and ground cover vegetation, a valve is considered to be accessible.
   (C)   Backflow preventer valve maintenance. No person shall remove or render inoperable a backflow preventer valve. It is the responsibility of the property owner to maintain any backflow preventer valve installed by the property owner or his or her predecessor in operable condition.
   (D)   Liability. Any property owner that is required to install and maintain a backflow preventer valve pursuant to this section shall be liable and responsible for any damages (of any kind or nature) resulting from a sewer backup to the owner’s property.
