Hen chickens may be kept within the city and its territorial jurisdiction subject to the following requirements.
(A) No more than six hen chickens may be kept on any single zoning lot.
(B) Hen chickens may only be kept on lots within the single-family zoning district.
(C) Hen chickens may not be kept on any vacant or uninhabited tract of land.
(D) No roosters may be kept or possessed within the city or its territorial jurisdiction.
(E) Hen chickens shall be kept within a covered enclosure during non-daylight hours. The covered enclosure or coop shall contain at least four square feet of floor area per fenced chicken. Hen chickens shall be kept in either a covered enclosure or a fenced enclosure during all daylight hours. The fenced enclosure shall provide at least ten square feet of open area per hen chicken. No coop shall exceed 120 square feet of floor area, and no coop shall exceed six feet in height.
(F) Hen chickens must be kept on the rear yard of the property. Rear yard means that portion of the lot between the rear of the dwelling and the rear lot line.
(G) The covered enclosure or fenced enclosure may not be located within ten feet of the property line of any adjacent property. No covered enclosure or fenced enclosure shall be located within 40 feet of any residential structure located on any other property.
(H) All enclosures for keeping hen chickens shall be so constructed and maintained as to prevent rats, mice and other rodents from existing underneath or within the enclosure.
(I) Any person who shall keep hen chickens shall be required to obtain an application for a permit to house hen chickens before hen chickens may be placed or brought upon any property. The application and a permit fee of $30 may be filed at the office of the city clerk who shall refer the application to the Zoning Administrator for review. Upon review, if a building permit application is necessary, the building permit application and fee shall be filed according to § 150.021 prior to the approval of the application for a permit to house hen chickens.
(J) All feed and materials used to maintain the hen chickens shall be protected so as to prevent rats, mice and other rodents from gaining access with the feed and/or materials.
(K) It shall be unlawful for any person who possesses, keeps or harbors hen chickens to allow hen chickens to run at large.
(L) No hen chicken may be slaughtered outside of an enclosed structure.
