521.13 STORAGE OF JUNK OR JUNK CARS PROHIBITED.
   (a)   For the purpose of this section, junk and junk cars are defined as follows:
      (1)   Junk. “Junk” means any worn-out, cast-off, or discarded article or material which is ready for destruction or has been collected or stored for salvage or conversion to some other use. Any article or material which, unaltered or unchanged and without further reconditioning, can be used for its original purpose as readily as when new shall not be considered junk.
      (2)   Junk car. “Junk car” means any used car or motor vehicle not in the process of reconditioning, which has been abandoned for use as a motor vehicle on a public highway and which is in unsafe operating condition and shall have remained in such condition for a period in excess of thirty days. Portions of junk cars, including, but not limited to the following, hoods, fenders, radiators, rims, motors, not being utilized for the repair of a motor vehicle, shall be considered as junk.
   (b)   No person, firm or corporation shall deposit, store, maintain, collect or permit the storage, deposit, maintenance or collection of any junk or junk cars in unenclosed areas on his premises or any premises under his control which are unenclosed open areas.
   (c)   Any motor vehicle parked or stored in violation of this section, after ten days’ notice of such violation mailed or delivered to the owner, may be removed to a motor vehicle pound or other place of storage by any police officer, and shall not be released except upon payment of towing and storage charges. Vehicles so removed may be disposed of according to the provisions of Ohio R.C. 4513.60 et seq.
   (d)   In the event the owner cannot be sound or his address is unknown, any motor vehicle parked or stored in violation of this section after thirty days’ notice to the owner of the premises upon which any such motor vehicle is parked or stored or person in possession thereof, or the agent of the owner, may be removed to a motor vehicle pound or other place of storage by any police officer and shall not be released except upon payment of towing and storage charges. Vehicles so removed may be disposed of according to provisions of Ohio R.C. 4513.60 et seq.

   (e)   Whoever violates this section is guilty of a minor misdemeanor. Each day during which such violation shall continue shall constitute a separate offense.
