1133.07 VARIANCES, DIVERGENCES, AND AMENDMENTS TO THE OVERLAY ZONING STANDARDS.
   (a)   Requests for revisions to an Overlay Zoning Standard In Zones 1, 3 and 4 other than for revisions to permitted uses shall be by request to the Board of Zoning and Building Appeals for a variance in accordance with Chapter 1127 of the zoning code. A request for a variance is not an application for rezoning but is an administrative action subject to appeal per
Chapter 2506 of the Ohio Revised Code.
   Requests for revisions to permitted uses shall be by request to amend the RFOD in accordance with Chapter 1129 of the zoning code. A request to amend the RFOD Is a legislative action subject to referendum and not subject to appeal.
   (b)   Revisions to an Overlay Zoning Standard in Zone 2 other than permitted uses shall be by request for a divergence with the submitted Development Plan to the Planning Commission to be approved or denied with the Development Plan. A request for a divergence is not a request for rezoning but is an administrative action subject to appeal per Chapter 2506 of the Ohio Revised Code.
   Requests for revisions to permitted uses shall be by request to amend the RFOD in accordance with Chapter 1129 of the zoning code. A request to amend the RFOD is a legislative action subject to referendum and not subject to appeal.
