(a) Any employee with ten or more years of service with the City shall be entitled to receive a cash payment based on the employee's rate of pay at retirement equivalent to one-half of the employee's accrued but unused sick leave at retirement.
(b) The term "retirement" as used in this section shall include death. In the event of death, if the employee would otherwise qualify for the cash payment provided in this section, then in that event, such payment shall be made to the surviving spouse of the employee and if there is no surviving spouse, then to the estate of the employee.
