(a) All employees, except department heads, shall be entitled to receive overtime compensation in accordance with the provisions set forth in this section.

(b) All covered employees shall accrue overtime for all hours worked in excess of the basic work week as defined in Section 159.16 at the rate of time and one-half. When an employee is called and instructed to report for work at a time other than the regularly scheduled work time, then such an employee shall be credited with a minimum of three hours overtime or the actual time spent, whichever is greater. Compensatory time off may be accrued up to eighty (80) hours of actual overtime worked with the equivalent of one hundred twenty (120) hours of time off. Use of compensatory time off shall be taken only upon a prior request by the employee and approval by the department head.

(d) A covered employee shall be entitled to receive pay for all overtime not otherwise taken as compensatory time off at the rate of one and one-half times the regular hourly rate as computed in accordance with Section 159.15. All overtime in excess of the amount allowed to be retained as compensatory time off, shall be paid to the employee.
(e) Upon termination of employment, employees holding accrued overtime, shall receive a lump-sum payment for that overtime equivalent to one and one-half times their regular rate at termination.
(f) The Mayor is authorized to adopt rules and regulations necessary to effectuate the provisions of this section.
