905.05 STORM SEWERS AND DRIVEWAY PIPES.
   (a)     All construction of storm sewers shall be of reinforced concrete pipe of smooth interior corrugated polyethylene pipe, twelve inches to thirty-six inches as per spec of the City, so as to protect the public from hazard, to prohibit the rusting of galvanized steel or other pipe, or the bending or crushing of such other pipe.
   (b)    Pipe larger than thirty-six inches in diameter or pipe installed below a depth of fifteen feet shall be approved by the City on a case-by-case basis.
   (c)    Only reinforced concrete pipe or Ohio Department of Transportation Material Specification Type 707.33 corrugated polyethylene smooth lined pipe shall be used as driveway pipe. The use of galvanized steel or other types of pipe for any driveway application is prohibited.
   (d)    All storm sewer and driveway pipe shall be installed and inspected, when necessary, in accordance with City standards. Ohio Department of Transportation standards will apply if an
item is not referenced by City standards.
   (e)    The replacement of damaged or nonfunctioning driveway or storm sewer pipe and maintenance of drainage ditches is the responsibility of the property owner and shall be performed in accordance with City standards and within a reasonable time limit set by the City, which shall never be less than thirty days. If the property owner fails to do so, the City shall undertake the project and replace damaged or nonfunctioning pipe or maintain drainage ditches, determine the cost of such project plus twenty percent (20%), and collect such charges from the individual property owner involved.
   (f)    Any drainage system designed to capture groundwater or surface water, whether it be a foundation drainage system or a rooftop drainage system whose discharge pipe is to be either above or below grade, shall be connected to a storm-sewer system, if one is available. If no storm-sewer system is available, then the drainage system shall discharge to a defined public drainage ditch, if one is available. If neither a storm-sewer system nor a public drainage ditch is available then the drainage system shall discharge to a grassy area located no further than 10 feet from the foundation of the structure from which the water is being drained. In no case shall this
be within 20 feet of a public sidewalk or roadway. In no case shall any drainage system discharge upon a public sidewalk or to a public roadway. In instances where no storm-sewer system, public drainage ditch, or grassy area located no further than 10 feet from the foundation of the structure from which the water is being drained is available, the Streets Superintendent or the Chief of the Division of Building and Zoning shall have the responsibility of deciding and approving what alternative fits the situation best. All discharge points and connections shall be inspected and approved by the Street Superintendent or the Chief of the Division of Building and Zoning.
   (g)    All modifications to driveway pipe, storm sewers or drainage ditches must be approved by the Street Commissioner and Chief of the Building and Zoning Departments. A "Permit to Work Within the Public Right-of-Way" is also required.
   (h)    For purposes of this section, "driveway pipe", "storm sewer pipe" and "drainage ditches" are hereby defined as any pipe, conduit or conveyance system through which storm or surface water is intended to travel, within any City street, right-of-way or public easement, such pipe, conduit or conveyance system being more or less parallel to such street or contained within such public easement.
   (i)    The size of storm water pipe or conveyance system which is to be utilized shall be determined by the various public officials involved, including but not limited to the Street Commissioner, Chief, Division of Building and Zoning, or their authorized agents. Such determination of size of pipe or conveyance system shall be made by the public official utilizing common sense, the anticipated amount of water to be handled by such pipe or conveyance system, the particular and peculiar circumstances surrounding the installation thereof, and the present and anticipated future needs of water capacity, traffic count, and any other related factors, but under no circumstances shall the size be less than a minimum of six inches in diameter for such pipe or conveyance system.
   (j)   All open drainage ditches must be designed and installed in accordance with City of Heath Standard Designs and Specifications. Design selected for specific ditches shall be approved by the Street Superintendent or Chief, Division of Building and Zoning, prior to installation, modification or improvement. (Ord. 21-2016.
