§ 155.51 IMPROVEMENTS MADE UNDER BOND OR OTHER SECURITY.
   (A)   When a bond, cash, check or other form of security is posted as provided in § 155.50, the Administrative Officer or Planning Commission may set a reasonable time for the improvements to be properly installed but no more than 18 months unless (1) the Administrative Officer or the Planning Commission shall otherwise provide for a longer period as a condition of approval of the plat; or (2) the Administrative Officer or the Planning Commission shall extend the time period for completion upon request and for good cause shown.
   (B)   The Board of Commissioners may release the security bond or cash only with the recommendation of the Planning Commission that the Board of Commissioners accept the dedication of the streets and other public grounds in the subdivision in question. The Planning Commission shall make this recommendation after it has received a report from the City Engineer that all improvements have been properly installed, that the final plat has been approved, and after the Planning Commission determines that all requirements of this chapter and the zoning code have been met.
   (C)   If improvements are not installed at the end of the initial period and if an additional period of time is allowed, the Planning Commission may order the Administrative Officer to cease from issuing building permits and certificates of occupancy in the subdivision in question until such time as the Planning Commission determines that the improvements are properly installed or sufficient action has been taken to install the improvements properly. At the end of the extended period of time, no building permits or certificates of occupancy shall be issued until all improvements are properly installed or sufficient action has been taken to install the improvements properly.
   (D)   If it is determined by the Planning Commission that the subdivider will not properly install the improvements and that the improvements are necessary for the public health, welfare, and safety, the Planning Commission may recommend to the Board of Commissioners that the city take action to notify the subdivider and utilize the posted bond, cash, or other form of security, to install the improvements. If this action is taken, no new building permit or certificate of occupancy shall be issued until all improvements are installed properly as determined by the Administrative Officer or Planning Commission, as applicable, for the minor or major subdivision.
