§ 53.99 PENALTY.
   (A)   Any person who is found to have violated an order of the Wastewater Control Board or who willfully or negligently fails to comply with any provision of this chapter and the orders, rules, and regulations issued hereunder shall be fined in an amount not exceeding $500 for each offense. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense.
   (B)   Violation of this chapter shall constitute a civil offense which shall be enforced according to the procedures set forth in the Hazard Code Enforcement Board Ordinance by the Code Enforcement Board, hearing officers, code enforcement officers, citation officers and other persons duly authorized to investigate and enforce the violations through investigation, inspection and issuance of citations.
   (C)   In addition to the penalty provided in division (A) of this section, the city may recover reasonable attorney’s fees, court costs, court reporter’s fee, and other expenses of litigation by appropriate suit at law against the person found to have violated this chapter or the rules and regulations issued hereunder.
