9-3-3: IMPOSITION OF FIRE AND EMS IMPACT FEE:
   A.   Imposition of impact fee. A Fire and EMS impact fee shall be imposed on all new development within city limits that are also within Fire District and EMS District boundaries, including all subsequently annexed areas upon the effective date of this ordinance.
   B.   Fee schedule. Fire and EMS impact fees shall be calculated in accordance with the Fee Schedule (produced below), which is based on the Impact Fee Calculation set forth in the capital improvements plan(s) for the Districts (see Exhibit III-3 for EMS District and Exhibit III-5 for Fire District) providing for standard fees based on the total number of dwelling units or square feet of nonresidential space in the development, unless:
      1.   The fee payer requests an individual assessment pursuant to section 9-3-6 of this chapter; or
      2.   The City and/or the Districts find the development will have an extraordinary impact pursuant to section 9-3-9 of this chapter. These impact fees are subject to change each year in accordance with the annual inflationary adjustment provided for in Section 9-3-3(C) below. The methodology for determining the costs per service unit provided for in the Fee Schedule is set forth in the capital improvements plan.
Nonresidential square footage, for the purpose of collecting nonresidential impact fees, shall be the square footage provided in the City’s permit application and verified in the most recently approved construction plans. If no permit application is required, as in the case of commercial recreational vehicle or campground developments, the square footage used for the impact fee calculations shall be two hundred forty square feet (240 ft2) per individual site multiplied by the total number of sites to be developed as detailed in the most recently approved construction plans.

   C.   Annual Inflationary Adjustment. By December 1 of each year, each District will submit a proposal for inflationary adjustments to the impact fees. These proposals will be reviewed by City Council for approval or denial. If the inflationary adjustment is approved by the City on January 1 of each calendar year, the impact fee will be adjusted to account for the proposed inflation adjustments. The index most widely used for this purpose is the Construction Cost Index (CCI) prepared by the Engineering News Record. This index measures the cost of construction materials and labor and is distinctly different from the Consumer Price Index. The Districts are required to use this index in calculating the annual adjustment to the established impact fees to be included in the Districts’ proposals.
   D.   Developer’s election. A developer shall have the right to elect to pay a project’s proportionate share of system improvements costs by payment of Fire and/or EMS impact fees according to the Fee Schedule as full and complete payment of the development project’s proportionate share of system improvements costs, except as provided in IC § 67-8214(3), as amended.
   E.   Procedures:
      1.   Building permit. Upon the imposition of the impact fees in accordance with Subsection A of this Section and upon submittal of complete building permit plans for the development to the City, the City shall provide the Fire and/or EMS impact fees for the development in accordance with the Fee Schedule and this Ordinance upon permit approval and preparation of the issuance, unless the fee payer requests an individual assessment or the City and/or Districts find the development will have an extraordinary impact pursuant to section 9-3-9 of this chapter.
      2.   Exemption. An exemption pursuant to section 9-3-5 of this chapter must be claimed by the fee payer upon application for a building permit or manufactured home installation permit. Any exemption not so claimed shall be deemed waived by the fee payer. (Ord. 637, 8-23-2022)
