3-4-14: PROHIBITED ACTS:
   A.   Purchases And Pledges From Minors: It shall be unlawful for a pawnbroker, or secondhand dealer, or recycler, or agent thereof to purchase any used or secondhand property from any person under the age of eighteen (18) years. It shall be unlawful for any pawnbroker or secondhand dealer or agent thereof to accept any article as a pledge for a loan from any person under the age of eighteen (18) years.
   B.   Employment Of Minors: It shall be unlawful for any pawnbroker, secondhand dealer, or recycler, or agent thereof to allow an employee under the age of eighteen (18) years to directly conduct a loan or sale transactions. An employee under the age of eighteen (18) years may, however, assist such pawnbroker, secondhand dealer or agent thereof in any other aspect of the business of such pawnbroker or secondhand dealer.
   C.   Persons Under Influence: It shall be unlawful for any pawnbroker, secondhand dealer, recycler or agent thereof to have any business dealings with an intoxicated person or one who is obviously under the influence of alcohol and/or drugs.
   D.   Specific Acts: It shall be unlawful for any pawnbroker, secondhand dealer, recycler or agent thereof to:
      1.   Failure To Record Entry: Fail to make a complete entry in the records as provided for in this chapter for each and every loan, purchase or other transaction; or
      2.   False Entry: Make any false entry therein; or
      3.   Time Limit For Records Maintenance: Falsify, obliterate, destroy or remove from his place of business, such book or record within three (3) years following the date of the last recorded transaction therein; or
      4.   Refusal Of Inspection: Refuse to allow the City Attorney or any representative thereof, or the Sheriff or any peace officer engaged in law enforcement within the City to inspect the records required herein or any goods in his possession, during the ordinary hours of business, or present items and pawn tickets to any Idaho peace officer; or
      5.   False Reporting: Report any material matter falsely to the City Attorney or his authorized representative, or the Sheriff or any peace officer of the City; or
      6.   Daily Forms To Sheriff: Having forms provided therefor, fail to make available, before twelve o’clock (12:00) noon of each business day, to the Sheriff a full, true and correct transcript of the record of all the loans, purchases or other business transactions had on the previous business day; or
      7.   Lost Or Stolen Property: Fail to report forthwith to the Sheriff the possession of any property which such pawnbroker, secondhand dealer or agent thereof, may have good cause to believe has been lost or stolen, together with the name of the owner if known, and together with the date such property was received, along with the name, description, date of birth and other material information required to be maintained by this chapter, of the person from whom the property was received; or
      8.   Redemption Period: Remove or allow to be removed, from his place of business, except upon redemption by the owners thereof, any property received during the redemption period, except as provided herein; or
      9.   Violation: Violate any provisions of this chapter or other ordinance of the City having application to the business or persons herein regulated. (Ord. 592, 4-9-2019; amd. Ord. 634, 6-14-2022)
