10-2-9: CERTIFIED ARBORIST REQUIRED:
   A.   When the pruning of public trees is undertaken by utilities and/or professional tree care operators, including any business performing tree care or trimming for a fee or compensation, such work shall be done under the direct supervision of a person qualified as a certified arborist by the International Society of Arboriculture. Compliance with this standard shall require that the certified arborist visit the site of the work to prescribe the pruning to be done and to actively monitor the pruning operation. This requirement shall not prohibit an adjoining home or business owner from carrying out minor pruning on public trees immediately adjoining his or her property so long as such minor pruning does not alter the essential shape of the tree or does not violate any of the specific prohibitions established by this chapter.
   B.   Any business pruning public trees for a fee or compensation must have in effect at the time the work is done a policy of liability and property damage insurance covering the work done and listing the city of Hayden as an additional insured in a sum not less than that provided by Idaho Code, section 6-926 et seq.
   C.   Any business pruning public trees shall be responsible for the work performed under the provisions of this chapter and shall comply with the requirements noted in the "Hayden Tree Standards Manual". In addition, all such businesses shall:
      1.   Utilize safety measures and equipment to protect the public as prescribed by law;
      2.   Obtain permits required for tree removal; and
      3.   Comply with all applicable ordinances of the city of Hayden and all applicable county, state, and federal laws. (Ord. 332, 12-16-2002)
