The applicant or any person engaged in or responsible for performing public works construction work without first executing a financial guarantee agreement or performing work contrary to the provisions of this chapter is in violation. Violation of any provision of this chapter shall constitute a misdemeanor and upon conviction, subject to penalty as provided in section 1-3-1 of this code.
