A. The City is a governmental entity that is empowered by the Act to adopt development impact fee ordinances and as such is authorized, by IC § 67-8204A, to enter into the intergovernmental agreement with the Districts for the purpose of agreement to collect and expend Fire and/or EMS Districts impact fees for system improvements as provided in this chapter.
B. The City and the Districts have entered into the intergovernmental agreements, which are in full force and effect upon effective date of this Ordinance.
C. The intergovernmental agreements comply with this chapter and requires the Districts to be governed by and to fully abide by the provisions of this chapter and Idaho Code.
D. Any amendments of the intergovernmental agreement shall be implemented by corresponding relevant amendments of this chapter, if needed, which amendments shall not apply to any Fire and/or EMS impact fees then not expended and currently held in the trust fund. (Ord. 637, 8-23-2022)
