§ 51.026 INDUSTRIAL SURCHARGE AND CIVIL PENALTIES.
   (A)   Industrial sewer users contributing wastewater of excessive strength shall be assessed a monthly surcharge for all excess pounds of waste. In computing the amount of high strength pounds contributed by a user, a wastewater allowance of two hundred and fifty (250) milligrams per liter of BOD 5 and SS and forty (40) milligrams per liter of ammonia nitrogen shall be deducted from the estimated or measured wastewater strength.
   (B)   All wastewaters containing five-day biochemical oxygen demand greater than two hundred and fifty (250) mg/l, suspended solids greater than two hundred and fifty (250) mg/l, and ammonia nitrogen measured as nitrogen greater than forty (40) mg/l shall be considered as being of excessive strength. Excess strength surcharges shall be applied to all concentrations of this waste above the aforementioned values. It is permissible for a wastewater to be considered as of excessive strength with regard to one or all parameters; however, a surcharge shall only apply to the excessive strength parameter.
   (C)   Industrial sewer users discharging under a permit shall be assessed a penalty for all pollutants that are specified as special pollutants in the permit and are released in excess of the limits provided in that user’s permit. This penalty will be assessed as a fine of $1,000 per day of violation.
