§ 52.100 PERMITS.
   (A)   Persons proposing to discharge nondomestic wastewater, or proposing to change the volume or characteristic of an existing discharge of nondomestic wastewater, shall apply for an industrial use permit from the Public Utilities Director. (An industrial user under this permit is not equivalent to a significant industrial user under the North Carolina Administrative Code.)
   (B)   The form of the industrial user permit application shall be prescribed by the Public Utilities Director, and shall include at least the following information:
      (1)   Name and address of the applicant, and location of the discharge site;
      (2)   Analytical data on wastewater constituents and characteristics, including any pollutants which the applicant knows or suspects are present in the discharge, as determined by a reliable analytical laboratory;
      (3)   Approximate time and duration of discharge into the POTW;
      (4)   Where known, the nature and concentration of any pollutants in the discharge which are limited by any City, state, or federal pretreatment standards, and a statement regarding whether or not the pretreatment standards are being met on a consistent basis and, if not, whether additional operation and management and/or additional pretreatment is required for compliance with applicable pretreatment standards;
      (5)   Toxic pollutants present within applicable pretreatment standards;
      (6)   Average daily and thirty-minute (30) peak wastewater flow rates; and
      (7)   Any other information as may be deemed by the POTW director to be necessary to evaluate the permit application.
   (C)   The Public Utilities Director will accept industrial use applications for the, which application shall be accompanied by a nonrefundable permit fee at the rates as are set from time to time by the Board of Commissioners will acknowledge receipt of completed applications or request additional information from applicants within thirty (30) days, and will take final action on completed applications within thirty (30) days of the acknowledgment of receipt, or receipt of additional information requested. The schedules of fees shall be kept on file in the office of the Clerk where they shall be available for public inspection during the normal office hours of the Clerk.
   (D)   The Public Utilities Director is authorized to:
      (1)   Issue an industrial user permit containing the conditions as are necessary to effectuate the purposes of this subchapter and G.S. § 143-215.1;
      (2)   Deny an industrial use permit application when, in the opinion of the Public Utilities Director, the discharge may cause or contribute to excessive loading of the POTW, to a pass through or an upset of the POTW, or where necessary to effectuate the purposes of G.S. § 143-215.1. The City will not accept any discharge identified as a significant industrial user by the State of North Carolina under North Carolina Administrative Code Title 15A, Subchapter 2H, § .0900; and
      (3)   Suspend an industrial use permit under § 52.103.
   (E)   Each permit shall be issued for a specified time period, not to exceed five years. Permits may be issued on a month-to-month basis (required for pretreated, contaminated groundwater discharge permits) or may be stated to expire on a specific date, at the discretion of the Public Utilities Director. Applications for reissuance of permits issued for one year or longer must be submitted to the Public Utilities Director at least one hundred and twenty (120) days prior to the expiration of the user’s existing permit. Industrial users with month-to-month permits need not apply for reissuance, and will be notified of an intention to discontinue the permit one month in advance. Month-to-month permit holders must notify the Public Utilities Director one month in advance of any significant changes in discharge rate or quality, and must give one-month’s notice before withdrawal from the system to avoid being charged.
   (F)   Industrial user permits are issued to a specific user for a specific operation. An industrial user permit shall not be reassigned, transferred, or sold to a new owner, new user, lessee, different premises, or a new or changed operation.
